AppDost provides comprehensive IT solutions including but not limited to:

If you are accessing our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

You retain all ownership rights to materials, content, and data you provide to us ("Client Materials"). By providing Client Materials, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such materials solely for the purpose of providing our Services.

5.3 Work Product

Upon full payment for our Services, you will receive ownership rights to the final deliverables as specified in your project agreement. We retain the right to use general knowledge, skills, and experience gained from providing Services, and to showcase completed projects in our portfolio (with your permission).

6. Payment Terms

Payment terms for our Services will be specified in individual project agreements. General payment conditions include:

• Quotes: All quotes are valid for 30 days unless otherwise specified
• Payment Schedule: Typically structured as milestone-based payments or monthly retainers
• Late Payments: Late payments may incur interest charges and may result in suspension of services
• Refunds: Refund policies are project-specific and will be outlined in your agreement
• Taxes: All prices are exclusive of applicable taxes unless stated otherwise

7. Project Changes and Scope

Changes to project scope, requirements, or deliverables after project initiation may require:

• Written approval via change order or amendment
• Additional fees based on the extent of changes
• Revised timelines to accommodate new requirements

We will provide detailed estimates for any scope changes before proceeding with the work.

8. Warranties and Disclaimers

8.1 Service Warranty

We warrant that our Services will be performed in a professional and workmanlike manner, consistent with industry standards. Any warranty claims must be made within the warranty period specified in your project agreement (typically 30-90 days).

8.2 Disclaimer

EXCEPT AS EXPRESSLY PROVIDED IN YOUR PROJECT AGREEMENT, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Services will be uninterrupted, error-free, or completely secure. You acknowledge that you use our Services at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• AppDost shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from or related to our Services shall not exceed the amount paid by you for the Services in the 12 months preceding the claim
• We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control

10. Indemnification

You agree to indemnify, defend, and hold harmless AppDost, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of another party
• Any Client Materials you provide to us

11. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of our business relationship. This obligation survives the termination of our Services.

Confidential information does not include information that:

• Is publicly available through no breach of this agreement
• Was known to the receiving party prior to disclosure
• Is independently developed without use of confidential information
• Is required to be disclosed by law

12. Termination

Either party may terminate an ongoing project or service agreement:

• For convenience, with written notice as specified in the project agreement
• Immediately, if the other party materially breaches these Terms
• Immediately, if the other party becomes insolvent or bankrupt

Upon termination, you remain responsible for payment of all Services rendered through the termination date. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Third-Party Services and Links

Our Services may integrate with or link to third-party services, platforms, or websites. We are not responsible for:

• The content, privacy practices, or terms of service of third parties
• The availability or performance of third-party services
• Any damages or losses caused by your use of third-party services

Your use of third-party services is at your own risk and subject to their terms and conditions.

14. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or our Services:

• Negotiation: The parties will first attempt to resolve the dispute through good-faith negotiation
• Mediation: If negotiation fails, the parties may agree to mediation
• Jurisdiction: These Terms shall be governed by the laws of India, and disputes shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar

15. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or technical failures.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending email notification for significant changes

Your continued use of our Services after changes become effective constitutes acceptance of the modified Terms.

17. General Provisions

• Entire Agreement: These Terms, together with any project-specific agreements, constitute the entire agreement between you and AppDost
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force
• Waiver: No waiver of any term shall be deemed a continuing waiver of such term or any other term
• Assignment: You may not assign your rights under these Terms without our prior written consent
• Relationship: Nothing in these Terms creates a partnership, joint venture, or employment relationship
